The present General Terms and Conditions (hereinafter, “Conditions”), regulate the use of the website https://shop.aguedapenha.com website (the “Service”) operated by Agueda Reboreda Peña, with NIF 77412495S, located in Carrer de Sant Agustí 5, 08012 Barcelona and e-mail email@example.com.
https://shop.aguedapenha.com is an online shop that sells handcrafted papercut paintings designed and produced locally in Barcelona, Spain.
Please read the Conditions carefully before using this website. By using this site or placing an order through this site, you agree to be bound by these Conditions; therefore if you do not agree with all the Conditions, you should cease the use of this site.
The purchase price set out in an offer is binding. Prices quoted to consumers include the statutory rate of VAT.
Prices are subject to change, but this will not affect orders for which I have already sent you a Shipment Confirmation. Please check current prices before placing an order.
Shipping costs are not included in the prices, they will be added to the total amount due as set out in the Shipping and Returns Policy.
Payment for the cart as well as for shipping costs will be made using credit card, Stripe or Paypal. You will be charged in EURO for your order.
Availability of Products
All orders are produced once the purchase has been made, i.e. on request. If difficulties arise in respect of the supply of products, or if any particular material is not in stock, I reserve the right to inform you about substitute products with the same or higher quality, which you will be able to order. If you do not want to order any of those substitute products, I will refund any prepaid amount.
Placing an Order
The Customer declares being at least 18 years old and having full legal capacity or in case of a minor, guarantees having parental permission to place the Order.
To place an Order, the Customer must follow the online purchase process and click on “Place Order” to submit an Order. The payment of the Order requires the acceptance of the Terms and Conditions, the price of the Items and the content of the Order. After validation of payment, you will receive an order confirmation email.
The items will be shipped to the delivery address indicated. Once the order has been dispatched, an e-mail will be sent to the client notifying of the orders dispatch. The order will be sent to the delivery address that the client has stated in the registry form- it is important that the client ensures that address details are correct as these cannot be modified, “https://shop.aguedapenha.com” cannot be held liable for lost orders related to an incorrect address or incomplete information entered on an order.
The client will be able to track the progress of their order. The liability of the items of “https://shop.aguedapenha.com” will be transferred to the client once the order has been delivered.
Delivery to Non-EU countries can incurre additional custom duties and value added taxes (VAT), which are not included in the price and shipping cost listed on my website. I am not responsible for covering these expenses and for delays due to customs.
After a delivery attempt, the transport service will leave the package in a safe place, and leave you a note to let you know where your package is and how to pick it up. If after 15 days the package has not been delivered for reasons not attributable to me, I understand that you want to cancel the Agreement and therefore it will be terminated.
Following such termination, I will refund the price paid as soon as possible and in any event no later than 30 days from the date on which I consider the Agreement to have been terminated. In such a case, I shall be entitled to charge you for the transport costs arising from the shipping costs and the termination.
Once you have received your order, you have 30 days to make a return. The right to cancellation will be applicable if and when the items returned to “https://shop.aguedapenha.com” are in the same condition in which they were received, along with the complete original packaging and protective elements. Any product that is returned faulty, damaged, dirty, used or deteriorated will not be refunded and will be available to the client being sent back to the address that the products have been shipped from.
If the mentioned conditions are complied with (regarding timeframe, communication and product condition) there will be a total refund in a maximum timeframe of 30 days.
How to cancel your order?
If you wish to cancel an order before it is in preparation, you can communicate this to the following address indicating the order number: firstname.lastname@example.org.
Governing Law and Jurisdiction
The use of our website and agreements for purchase of products through this website will be governed by the Spanish law.
Any dispute arising from or related to the use of the website or to said agreements will be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals. If you are contracting as a consumer, nothing in this clause will affect your statutory rights under the current applicable law.
